This appeal is directed against the order dated 11.07.2023, passed by the learned Special Judge, SC/ST Act-cum- Additional Sessions Judge-I, Garhwa in SC/ST Case No. 03 of 2023 arising out of Majhiaon P.S. Case No. 17 of 2023, whereby and wherein, the learned Special Judge, SC/ST Act-cum- Additional Sessions Judge-I, Garhwa rejected the bail application of the appellant.
2. Appellant is alleged to have established consensual physical relationship with the prosecutrix who is aged about 19 years, on the promise of marriage. Later, the appellant refused to marry her.

Learned counsel for the appellant submitted that charge has already been framed in this case. It was further submitted that the victim is a major lady and medical evidence does not support the prosecution case.
4. Mrs. Lily Sahay, learned A.P.P has opposed the prayer for bail and submitted that the prosecutrix is a member of Scheduled Caste.
5. Considering the nature of allegation, I am inclined to release the appellant on bail. Accordingly, appellant, above named, is directed to be released on bail, on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty
2. Thousand) with two sureties of the like amount each, to the satisfaction of learned Special Judge, SC/ST Act-cum-Additional Sessions Judge-I, Garhwa in connection with SC/ST Case No. 03 of 2023 arising out of Majhiaon P.S. Case No. 17 of 2023.
This appeal is allowed and the order dated 11.07.2023 passed by the learned court below is set aside.
