The instant bail application has been preferred by the petitioner for grant of regular bail in connection with S.T Case No. 39 of 2025 arising out of Kuchai (Dalbhanga O.P) PS Case No. 26 of 2024, registered for the offence under Sections 103(1)/3(5) of the B.N.S, 2023 and under Sections 25(1-B)(a)/27 of the Arms Act and subsequently charges have been framed under Sections 103(1), 3(5), 238/3(5) of BNS and under Section 27 of the Arms Act. 3. Learned counsel for the petitioner submits that the co-accused, namely, Sahdev Munda @ Ranga in B.A No. 5089 of 2025, Budhram Munda @ Mukhiya @ Durpa in B.A No. 5172 of 2025 and Kinuram Munda in B.A No. 5176 of 2025 have been granted bail on 25.06.2025, 03.07.2025 and 03.07.2025 respectively by the Co-ordinate Bench of this Court. He submits that the petitioner is in custody since 27.09.2024 as such, the petitioner may be enlarged on bail. 4. Learned APP opposes the prayer for bail. 5. Having regard to the aforesaid facts and circumstances coupled with the fact that the co-accused have been granted bail by a 2025:JHHC:23141 2 Co-ordinate Bench of this Court and the petitioner is in custody since 27.09.2024, I am inclined to enlarge the petitioner on bail and accordingly, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-1 at Seraikella in connection with S.T Case No. 39 of 2025 arising out of Kuchai (Dalbhanga O.P) PS Case No. 26 of 2024. 6. It is made clear that the petitioner shall appear on each and every date before the learned trial Court and he shall not threaten any witness and shall cooperate in trial and if any adverse report will come against this petitioner, learned trial Court shall be at liberty to cancel the bail of this petitioner.
