[2025:RJ-JP:23821] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 8886/2025 Farooque Husain Son Of Shri Allahdiya, Aged About 49 Years, Resident Of Badi Masjid Ke Pass, Mohalla Sadat, Malpura, District Tonk, Rajasthan. Employee Id Rjt0201636003123 ----Petitioner Versus 1. State Of Rajasthan, Through Principal Secretary, Medical And Health Department, Government Of Rajasthan, Secretariat, Jaipur. 2. Director (Non-Gazetted), Medical, Health And Family Welfare Services And Additional Director, (Admn.) Panchayati Raj (Medical) Department, Rajasthan, Jaipur. 3. Chief Medical And Health Officer, District Hospital Malpura, District Tonk. ----Respondents For Petitioner(s) : None present For Respondent(s) : HON'BLE MR. JUSTICE SUDESH BANSAL Order 30/06/2025 1. Instant writ petition under Article 227 of Constitution of India has been filed by the petitioner challenging the order dated 27.02.2025 passed by the Rajasthan Civil Services Appellate Tribunal, Jaipur, dismissing appeal No.1554/2025 of petitioner and affirming the transfer order dated 15.01.2025 whereby and whereunder petitioner was transferred from District Hospital Malpura, District Tonk to Sub-District Hospital Dechu, District Phalodi. [2025:RJ-JP:23821] (2 of 2) [CW-8886/2025] 2. Having perused the record, it appears that petitioner assailed the transfer order dated 15.01.2025 by way of appeal before Rajasthan Civil Services Appellate Tribunal, Jaipur on the ground of adversarial circumstances of family and in the appeal, on the concession of counsel for petitioner-appellant, he was given liberty to submit a representation and the appeal was not argued on merits by counsel for the appellant. 3. Hence, in such backdrop of facts, this Court is of the considered opinion that petitioner is estopped to further challenge the transfer order on merits, invoking the writ jurisdiction of this Court. 4. Accordingly, the writ petition is hereby dismissed. 5. All pending application(s), if any, stand(s) disposed of. (SUDESH BANSAL),J TN/32
