Neutral Citation No. - 2025:AHC:25266 Court No. - 34 Case :- WRIT - C No. - 5086 of 2025 Petitioner :- Manna Lal Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Akhilesh Kumar Singh,Kunwar Bhaskar Parihar Counsel for Respondent :- C.S.C.,Hari Narayan Singh Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the parties and perused the record. 2. This petition has been filed for the following relief: "A. To issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 27.6.2024 passed by respondent no. 3 and impugned appellate order dated 30.08.2024 passed by respondent no. 2 (Annexure No. 8 and 9 to this writ petition). B. To issue a writ order or direction in the nature of mandamus commanding directing the respondents restraining them from interfering in peaceful possession of petitioner in any manner in the interest of justice." 3. Learned Standing Counsel has raised a preliminary objection that against the appellate order passed in proceedings under Section 38(4) of the U.P. Revenue Code, 2006, the petitioner has an alternative remedy of filing revision under Section 210 of U.P. Revenue Code, 2006. 4. Since the petitioner has an alternative remedy, I am not inclined to entertain the instant petition. 5. Accordingly, the writ petition is disposed of with liberty to the petitioner to avail the remedy as available to him, in accordance with law.
