GP FOR SCHOOL EDUCATION (AP) The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 13707 of 2019 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate writ more in the nature of Writ of Mandamus declaring the action of the 3rd Respondent District Collector in issuing instructions to the 4th Respondent District Educational Officer ignoring the fact that he is not a statutory/hierarchal authority prescribed under AP Education Act or the Rules framed there under in taking administrative decision and directing the 4th Respondent District Educational Officer to shift the staff working in private educational institutions to some other private educational institutions or to the Mandal Parishad and Zilla Parishad Schools violating Article 14, 19 as being arbitrary illegal of the Constitution of India and Subversive of the provisions of the AP Education Act 1982 and the Rules framed there under and as being without jurisdiction and consequently direct the 3rd Respondent District Collector to refrain from issuing any instructions to the Educational authorities and directions to the 4th Respondent District Educational Officer to strictly adhere to the hierarchal setup as prescribed under the Rules and issue such other writ or order or direction as deemed fit and proper in the circumstances of case…” 2. When the matter is taken up for hearing, Sri Sri Vijay Mathukumilli, learned Counsel for the Petitioner would submit that the petition may be disposed since the relief has become infructuous. 3.
