Also heard Mr. A Phukan, learned Standing Counsel, Elementary Education for the respondents No. 1, 2, 3 & 56 and Ms. U Sharma, learned Jr. Government Advocate for the respondent No. 4. The petitioner is before this Court seeking order from the Court to reinstate the petitioner pursuant to his suspension vide order dated 04.06.2023. The petitioner also questioned the disciplinary proceedings initiated against him. On instructions Mr. A. Phukan, learned Standing Counsel, Elementary Education submits that by order dated 22.07.2025, the disciplinary proceedings have been concluded and the disciplinary authority was pleased to impose the penalty of dismissal from service which shall ordinarily be a disqualification for future employment under Rule 7(vii) of the Assam Service (Discipline and Appeal) Rules, 1964 upon the petitioner who was serving as Deputy Inspector of Schools, Guwahati. Page No.# 3/3 In that view of the matter, the petitioner does not wish to press the writ petition any further. He seeks liberty to approach the Court putting to challenge the order of dismissal.
