- Versus - The State of Jharkhand
… Opp. Party
------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH
----- For the Petitioner : Mr. Abhishek Singh, Advocate For the State
: Mr. Sardhu Mahto, A.P.P.
--- 02/29.08.2025
Heard the parties.
The petitioner has been made accused in connection with Tundi P.S. Case No. 59 of 2023, S.T. Case No.821 of 2023, for the offences registered under Sections 398/34 of the Indian Penal Code and Section 25(1-B)(a)/35 of the Arms Act, pending in the court of learned Additional Sessions Judge, Dhanbad. Bail application of the petitioner was earlier rejected by this Court in B.A. No.8105/2024 by order dated 06.01.2025. On 08.08.2023, five unknown persons waylaid the informant near Water Tank at Thetatand and attempted to snatch money from him. The Informant raised alarm, on which, people of the locality gathered there and apprehended the petitioner at the place of occurrence itself. It was submitted that petitioner is in custody for more than two years. It was further submitted that co-accused Akbul Ansari has been granted bail by this Court vide B.A.No.6667 of 2025 and the case of the petitioner stands on similar footing.
In view of the aforesaid facts, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge, Dhanbad, in connection with Tundi P.S. Case No. 59 of 2023, S.T. Case No.821 of 2023.
