ORDER Date : 12.02.2025 Heard Mr. D. Mondal, learned counsel for the applicant along with Mr. S. K. Goswami, learned counsel for the respondent Insurance Company. This is an application for withdrawal of 50% of the awarded
Page No.# 2/2 amount, which was deposited by the Insurance Company into this Registry on 11.11.2024. The learned counsel for the applicant submits that the applicant is the mother of the deceased son and the claimant in the MACApp./270/2024. Mr. S. K. Goswami, learned counsel for the respondent Insurance Company submits that he has no objection to the application made but submits that the said amount may be allowed to be withdrawn subject to a bond executed by the applicant considering that the owner of the accident vehicle is the husband of the applicant. Having heard the submissions made by the learned counsel for both the parties, the instant application is allowed to withdraw the deposited 50% of the awarded amount subject to execution of a bond by the applicant. Registry is directed to do the needful after due verification. Accordingly, the I.A.(Civil)/3921/2024 stands allowed and
