THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE B M SHYAM PRASAD ORAL ORDER The petitioner has sought for directions to the respondent, and the petitioner's prayer reads as under: "Issue Mandamus directions to the respondent authority to take all the subjects in the timings meeting agenda dated 05.03.2025 No.RTO/TMK/RTA/2024-25 marked ANNEXURE-B to the writ petition on the same date in the future with prior 7 days' notice to the applicants/objectors by way of digital communication to their mobiles or email or by hosting agenda in the official website for the convenience to all the sector operators in the region." - 3 - NC: 2025:KHC:11283 WP No. 7854 of 2025 2. Sri R Lokesh, the learned counsel for the petitioner, submits that the Notice dated 05.03.2025 is for scheduling a Meeting for reassignment of timings to the permit holders in different Sectors and such Meeting is now postponed; that if another Meeting is scheduled without due notice, the petitioner and other similarly placed persons would be affected; and that as such, this Court must direct the respondent to inform the date of the next Meeting with prior seven days’ notice to the permit holders via mobile phone numbers/e-mail IDs and also publish the date of the Meeting on the respondent's website. 3. Sri R Lokesh further submits that this Court may direct the respondent to insist upon all the permit holders to furnish their mobile phone numbers/e-mail IDs for due communication to the Meetings scheduled for revising/reassigning the timings emphasizing that the communication through these modes would ensure that the litigation - 4 - NC: 2025:KHC:11283 WP No. 7854 of 2025 on the ground of lack of opportunity of hearing is minimized. 4. Sri Rajkumar, a learned Additional Government Advocate, who is called upon to accept notice for the respondent, submits that there should be no impediment for communication of the details of the Meeting scheduled for reassigning the timings on mobile phone numbers/e-mail IDs if the concerned furnish these details. When queried, Sri Rajkumar, on instructions, submits that it would not be difficult for the respondent to put in the necessary facilities to ensure that the Communication of the Meetings is sent on mobile phone numbers/e-mail IDs and also publish the same on the respondent's website. 5. These responses persuade this Court to dispose of this petition directing the respondent to [a] publish on its website the instructions to all the permit holders/objectors to furnish their respective mobile phone numbers/e-mail IDs; [b] to publish such - 5 - NC: 2025:KHC:11283 WP No. 7854 of 2025 instructions within a period of seven [7] days from the date of receipt of a certified copy of this order; [c] if the concerned register these details pursuant to such instructions on the website, to send communication of the Meeting scheduled also on such mobile phone numbers/e-mail IDs mobile phone numbers/e-mail IDs. The petitioner is also reserved to file a certified copy of this order with the respondent within a week from the date of receipt of a certified copy of this order. 6. At this stage, Sri R Lokesh submits that this Court may direct the respondent to defer the Meeting that is scheduled for consideration of some of the matters that are listed in the Notice dated 05.03.2025 and that such deferment should be for a reasonable period until the facility for communication through mobile phone numbers/e-mail IDs is put in place. Responding to this request, Sri Rajkumar submits that this Court may observe that the - 6 - NC: 2025:KHC:11283 WP No. 7854 of 2025 petitioner would be at liberty to file a representation with the respondent for such deferment. 7. This response is found reasonable and while disposing of the petition with the directions as aforesaid, the petitioner is also reserved with liberty to seek deferment of the Meeting scheduled if any until the respondent puts in place the necessary facility to facilitate publication of Notice on its website and communication of the notice of Meeting on mobile phone numbers/e-mail IDs directing the respondent to consider the same subject to all practical difficulties.
