For Petitioner : Mr.S.Ramsundarvijayraj For Respondents : Ms.K.Malathi, Additional Government Pleader for R1 to R3 Mr.A.Albert James Government Advocate (Criminal Side) for R4 & R5 ORDER This Writ Petition has been filed seeking a mandamus directing respondents 1 to 3 to grant permission to conduct Kida-Muttu cultural event during Thaithirunaal (Pongal) festival on 18.01.2026 at Singarajapuram Village, Andipatti taluk, Theni District. 2. The learned counsel appearing for the petitioner would submit that the petitioner Sangam has made an application to the respondents to grant permission to conduct Kida-Muttu on 18.01.2026. Reference is made to the Division Bench Judgment of this Court in M.Ganesan vs. 1.The District Collector, Collectorate, Sivagangai and others in W.P.(MD)No.11751 of 2023, dated 11.05.2023, wherein in paragraph nos. 3 & 4, it is held as follows:- "3. Learned counsel for the petitioner draws our attention to the order dated 11.01.2022 made in W.P.(MD).No.528 of 2022 filed by an association. In the said order, the following directions had been incorporated: 6.This Court, in Similar circumstances, allowed W.P.(MD).No. 10771 of 2013 by order dated 05.07.2013 permitting cock-fight, imposing certain conditions. Following the said order, the second respondent is directed to grant permission to the petitioner to conduct 'Kida-Muttu' event on 22.01.2022 at Mamarthupatti, Madurai District, subject to the following conditions: "(i) The 'Kida-Muttu' event to be held on 22.01.2022 shall be supervised by the third respondent as well as by the Veterinary Doctor of nearby Government Veterinary Hospital. (ii) During the course of conducting 'Kida-Muttu', it is to be ensured that there should not be any injury caused to the goats, involving in the event, and the goats should not be intoxicated with any alcoholic substance and to knives should be tied around the legs, horns of the goats, with the tip of the knives dipped in poisonous substances. The Veterinary Doctor shall ensure the same before starting of the event. (iii) The petitioner shall bear the expenses towards police protection as well as the expenses towards the Veterinary Doctor. 3/8 https://www.mhc.tn.gov.in/judis W.P.(MD)No.34224 of 2025 (iv) It is made clear that the organizers should take all precautionary measures to avoid any untoward incident while conducting the event of 'Kida-Muttu'. (v) The second respondent while issuing the proceedings permitting the holding of the event shall stipulate appropriate conditions for adhering to Covid-19 protocol. I make it clear that the order has been passed in this writ petition based on the position obtaining today. It is of-course open to the second respondent to take a call, if any further lock down restriction is imposed by the Government. (vi) All the above terms and conditions should be followed scrupulously by the petitioner and the petitioner shall file an affidavit of undertaking to the said effect before the second respondent. 4. We direct the third respondent to issue proceedings permitting the petitioner to hold the event by incorporating appropriate conditions as mentioned above." 4. A perusal of the above Judgment shows that certain directions have been issued by the Division Bench for conduct of Kida-Muttu event. Since the issue is one and the same, the above Judgment is squarely applicable to the facts of this case. 5. The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that if permission is granted for conduct of 4/8 https://www.mhc.tn.gov.in/judis W.P.(MD)No.34224 of 2025 such events, law and order problems might arise and hence, prayed for dismissal of this Writ Petition. 6. According to the learned counsel for the petitioner, not more than 500 people are going to assemble for the Kida-Muttu event. If people assemble for festival or events, some problems may arise. In such situations, it is the responsibility of the police officials to maintain law and order. A persons holding the post of District Collector / Superintendent of Police, cannot say that law and order problem will arise and such submissions made by the learned Additional Government Pleader can only be considered as the incapacity of the officials to manage the affairs. When people in the city assemble in large numbers, in and around 30,000 in a stadium, the Police officials are able to provide protection by allocating 2,000 to 3,000 Police personals or more. In the same way, the village people are entitled to have rituals / festivals that have been celebrated by them for time immemorial. Even the people who left the Village to other Cities and Countries, might come back and assemble during such festivals. Such festivals are the only way of celebration for the Village people. Therefore, it is the bounden duty of the respondents officials to provide permission and necessary protection for such events. 5/8 https://www.mhc.tn.gov.in/judis W.P.(MD)No.34224 of 2025 7. In the result, the Writ Petition is disposed of and the first respondent is directed to consider the petitioner's representation dated 20.11.2025 and permit them to conduct Kida-Muttu event, by imposing conditions as set out in the above mentioned Division Bench Judgment and also provide police protection, if necessary. No costs.
