2025:JHHC:12103 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 5197 of 2024 1. Kedar Yadav 2. Raj Kumar Yadav @ Chhotan Yadav, S/o Jado Gope, R/o village Romi, PO Pelawal, PS Katkamsandi, District Hazaribag ….. Petitioner(s). Versus The State of Jharkhand ….. Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the petitioner(s) : Mr. Sidhant Sinha, Advocate For the State : Mr. Azeemuddin, APP ----- 05/23.04.2025: This is an application filed by the petitioners praying for grant of anticipatory bail in terms of sections 482 and 484 of the Bhartiya Nagarik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in a criminal case registered for the offences punishable under sections 341, 342,323,307/34 of the Indian Penal Code, in connection with Sadar PS Case No. 157 of 2024, pending in the court of learned C.J.M., Hazaribag. 2. Heard the learned counsel for the petitioners and the learned counsel for the State. 3. The learned APP opposes prayer for anticipatory bail of the petitioners. 4. As per paragraph no. 63 of the case diary, statement of Mohan Rana, son of Basudev Rana, resident of Romi, Thana Katkamsandi, Pelawal O.P., District Hazaribagh, was recorded. In his statement, he fully supported the incident and told that on 19.04.24, he was dancing in the Ramnavami procession, and at about 12.30 p.m., as soon as Romi's Ramnavami procession reached near the gate of Sadar Hospital, he was hit below his navel by a bhujali (a weapon) thrown by Sushil Yadav @ Jakal Yadav, due to which he got injured. He fell on the ground after getting injured and started bleeding. When his family members present in the procession protested against this, Sushil Yadav @ Jakal Yadav and his brothers Rajkumar Yadav @ Chotan Yadav and Kedar Yadav got agitated and started beating his family members as well. After this with the help 2025:JHHC:12103 of people involved in the procession, the fight was pacified. Then he was taken to Sadar Hospital for treatment. The petitioner thereafter fainted. When he regained consciousness, he was found being treated at Ford Hospital from where he was referred for better treatment. Thereafter, he was taken to Chandra Hospital and Research Center, Boria, Ranchi for treatment. 5. In view of the aforesaid facts, and as there is allegation of assault by these petitioners, I do not find this case fit for grant of anticipatory bail. Hence, the present anticipatory bail application is dismissed. (ANANDA SEN, J. ) KNR/
