1. By the present writ petition, though the petitioner is questioning the order dated 26/12/2024 (Annexure P/1) passed by respondent No.1 by which the charge of Chief Municipal Officer, Nagar Panchayat, Barela has been withdrawn from the petitioner and he has been directed to join his original posting as Assistant Revenue Inspector, Nagar Palika Parishad, Bemetara however, the petitioner presently seeking a direction towards the respondent authorities to consider his representation dated 30/12/2024.

Learned counsel appearing for the State as well as the counsel for the Intervenor would submit that the impugned order which is under challenge is not a transfer order. In fact, the charge of Chief Municipal Officer which was given to the petitioner has been withdrawn and the petitioner has been directed to join his original posting and on the same day, the intervenor has been promoted and posted as Chief Municipal Officer, Nagar Panchayat, Barela.
Learned counsel further submits that there is no ground remains to the petitioner to question the order dated 26/12/2024.
3. I have heard learned counsel for the parties and perused the documents.

Looking to the submission made by learned counsel for the petitioner that he is only seeking a direction towards the respondent authorities to consider his representation pending before respondent No.1, the respondent authorities are directed to consider and decide the representation submitted by the petitioner in accordance with law, within a period of 35 days from the date of
3 / 3 receipt of a copy of this order.

Since the petitioner is not pressing the relief sought in the writ petition by which he is seeking quashment of the order dated 26/12/2024, the interim order granted by this Court on 14/01/2025 is vacated and the intervenor be permitted to continue his work as Chief Municipal Officer, Nagar Panchayat Barela.
6. With the aforesaid direction, the Writ Petition stands disposed of. Sd/- (BIBHU DATTA GURU)
