Writ Petition No.4242 of 2025 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 17.02.2025 CORAM THE HONOURABLE MR.JUSTICE N.ANAND VENKATESH Writ Petition No.4242 of 2025 & W.M.P.No.4746 of 2025 S.Krishna S/o.Shanmugasundaram ... Petitioner Vs. 1.The District Collector, First Floor, Collectorate, Erode -638 011. 2.The Tahsildar/Revenue Tahsildar, Office of the Tahsildar, Modakurichi Taluk, Erode - 638 104. 3.The Village Administrative Officer, Aavalapoodurai (B) Village, Modakurichi Taluk, Erode - 638 104. ... Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus calling for the records of the second respondent tin O.M.No.3403/2024/A3 dated 16.07.2024, quash the same and consequently, direct the respondents to provide necessary revenue records for the petitioner's land and VAO certificate to the petitioner within a time frame fixed by this Court. 1/6 https://www.mhc.tn.gov.in/judis Writ Petition No.4242 of 2025 For Petitioner : Mr.C.Vigneswaran For Respondents : Mr.P.Sathish Additional Government Pleader ***** O R D E R This writ petition has been filed challenging the impugned proceedings of the second respondent dated 16.07.2024 and for a consequential direction to the respondents to provide copies of the revenue records sought for by the petitioner with respect to the subject property. 2. Heard Mr.C.Vigneswaran, learned counsel for petitioner and Mr.P.Sathish, learned Additional Government Pleader appearing for respondents. 3. The main grievance that was expressed by the learned counsel for the petitioner is that the petitioner wanted copies of certain revenue records in order to enable the petitioner to apply for agricultural electricity service connection. On receipt of the same, the second respondent, through impugned proceedings dated 16.07.2024, has only dealt with the entitlement of the petitioner with respect to the agricultural 2/6 https://www.mhc.tn.gov.in/judis Writ Petition No.4242 of 2025 electricity service connection and such request has been rejected on the ground that there is a pending suit. Learned counsel for petitioner submitted that the petitioner is not even a party to the suit and to substantiate the same, copy of the plaint filed in O.S.No.123 of 2023 on the file of District Munsif, Erode, has been produced. Learned counsel, therefore, submitted that the present writ petition confines itself only to furnishing copies of the revenue records sought for by the petitioner and this writ petition does not directly touch upon the agricultural electricity service connection that was sought for by the petitioner . 4. This Court carefully went through the representation dated 25.06.2024 which has been taken note of in reference No.1 in the impugned proceedings. In the said representation, the petitioner has only made the following request: @nkw;go Mtz';fis bgw ntz;o g{e;Jiw?fpuhk epu;thf mYtyfuplk; gy Kiw neupy; brd;Wk;. gpd;Dk; jghy; K:ykhf nfl;l nghJk;. c';fs; epyj;jpd; kPJ tHf;F cs;sJ/ Mjyhy; Mtz';fis ju KoahJ vd;W Twpdhu;/ nkw;go ru;nt vz; kPJ tHf;F VJk; ,y;iy vd;W ePjpkd;wj;jpy; cj;jput[ bgw;W mij neupy; fhz;gpj;Jk; K:d;whk; egu; jiyaPl;lhy; ju kWj;J tUfpwhu;/ jw;nghJ c';fs; ghu;itf;F gj;jpu efy;. gl;lh. rpl;lh efy;fis ,izj;Js;nsd;/ nkw;go 3/6 https://www.mhc.tn.gov.in/judis Writ Petition No.4242 of 2025 Mtz';fis guprPypj;J tptrha kpd; ,izg;g[ bgw njitahd Mtz';fis bfhLf;f fpuhk epu;thf mYtyUf;F cj;jput[ ,LkhWk;. vdf;F kpd; ,izg;g[ bgw njitahd Mtz';fis jUkhW j';fis jhH;ika[ld; nfl;Lf; bfhs;fpnwd;/@ 5. The above request made by the petitioner was not directly dealt with and what has been dealt with is the consequential agricultural electricity service connection that was sought for by the petitioner. It comes into play only after the petitioner receives the revenue document that has been sought for. Therefore, the second respondent need not have gone into the issue of entitlement of the petitioner for agricultural electricity service connection and there was no need for referring to pending suit in which the petitioner is not even a party. 6. In the light of the above discussion, there shall be a direction to the second respondent to deal with the representation made by the petitioner dated 25.06.2024 wherein the petitioner has only sought for copies of certain revenue records. To that extent, the representation shall be dealt with and the copies shall be furnished to the petitioner. This process shall be completed within a period of two (2) weeks from the 4/6 https://www.mhc.tn.gov.in/judis Writ Petition No.4242 of 2025 date of receipt of a copy of this order. Insofar as the entitlement of the petitioner to get the agricultural electricity service connection is concerned, this Court is not inclined to go into that issue in this writ petition. That dispute has to be independently agitated by the petitioner. This writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed. 17.02.2025 Neutral Citation: Yes/No Index: Yes/no Speaking Order/Non-Speaking Order gm To 1.The District Collector, First Floor, Collectorate, Erode -638 011. 2.The Tahsildar/Revenue Tahsildar, Office of the Tahsildar, Modakurichi Taluk, Erode - 638 104. 3.The Village Administrative Officer, Aavalapoodurai (B) Village, Modakurichi Taluk, Erode - 638 104. 5/6 https://www.mhc.tn.gov.in/judis Writ Petition No.4242 of 2025 N.ANAND VENKATESH, J gm Writ Petition No.4242 of 2025 17.02.2025 6/6 https://www.mhc.tn.gov.in/judis
