Present applicant–Santosh Kumar is seeking bail in relation to F.I.R No.267 of 2023, in which after investigation, the charge-sheet has been filed against the applicant for the offences punishable under Section 302, 201 and 364 of I.P.C., P.S. Kichcha, District Udham Singh Nagar in Sessions Trial No.236 of 2023. 4. After submission of the charge-sheet, the cognizance has been taken and the Sessions Trial No. 236 of 2023 is going on. 5. Learned counsel for the applicant submits that the applicant is innocent and he has three children, but only on the instance of one child, the applicant has been implicated. 6. Mr. V.S. Pal, learned AGA for the State also submits that on the pointing out of the applicant, the dead body of the deceased was recovered. 7. I have perused the FIR and the charge- sheet and keeping in view of the seriousness of the crime, this Court is of the view that instead of enlarging the applicant on bail, the trial should be expedited. 8. I do not find any merit on the instant bail application, accordingly, the instant bail application is dismissed. However, the trial court is directed to expedite the Session Trial No.236 of 2023 as early as possible on its own merit without being influenced with the observation of this Court. 9.
