JUSTICE MITALI THAKURIA ORDER 06.01.2025 Heard Mr. S. Gogoi, learned counsel for the petitioner. Also heard Mr. R. J. Baruah, learned Additional Public Prosecutor for the State respondent. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for grant of pre-arrest bail to the accused/petitioner, who is behind the jail hazot since 16.07.2024 in connection Tezpur P. S. Case No.416/2024 corresponding to G. R. Case No. 1132/2024, registered under Sections 21(C)/29 of NDPS Act. Mr. Baruah, learned Additional Public Prosecutor, submits that though the case was listed today for production of the Case Diary before this Court, but the I.O. has already filed Charge-Sheet in this case, vide Charge-Sheet No. 577/2024, dated 13.12.2024. In this context, Mr. Gogoi, learned counsel for the petitioner, submits that the present petitioner is behind the bar since 16.07.2024 and hence he prays to grant bail to the petitioner considering his length of detention. Considering the submissions of learned counsels for both sides and also considering the fact that the case has already been Charge-Sheeted, vide Charge-Sheet No. 577/2024, dated 13.12.2024, it is provided that the petitioner shall file a petition for grant of regular bail before the learned Court below, and the said Court shall consider the same in accordance with law.
