The learned Sessions Judge has dismissed the petition mainly on the ground that the earlier petition filed by the petitioners in Crl.M.P.No. 20 of 2025 was allowed on condition of payment of Rs.1,500/- to each of the witnesses on or before 14.02.2025, and since the petitioners did not comply with the said condition, the petition came to be dismissed, and the instant petition has been filed only to delay the trial. _____________ Page No. 2 of 5 https://www.mhc.tn.gov.in/judis Crl.O.P.(MD) No.18405 of 2025 3. The learned counsel for the petitioners would submit that the petitioners could not cross-examine P.W.1 and P.W.24, and that one more opportunity may be granted to the petitioners. 4. The learned Additional Public Prosecutor, on instructions, would submit that the case is now posted for arguments and that the instant petition has been filed only to delay the trial. 5. Admittedly, the petitioners had earlier filed Crl.M.P.No.20 of 2025 for recalling P.W.1 and P.W.24 for cross-examination. They did not comply with the condition imposed by the learned Sessions Judge to pay a sum of Rs.1,500/- to each of the witnesses. Hence, the said petition was dismissed. The petitioners have not chosen to challenge the said order so far. Instead, they have filed the instant petition six months later seeking the same relief.
