06/ 24.04.2025 Heard the parties. 2. This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 302, 307 and 34 IPC and Section 27 of the Arms Act. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. It is alleged that due to a land dispute where the boundary wall of the informant was being demolished, the entire incident occurred. The informant and others went to stop the persons who were present but one Manoranjan Giri shot Janki Yadav and Pawan Kumar Yadav. Janki Yadav later on died. 5. From the case diary and the F.I.R. and also from the submission of learned A.P.P., I find that this petitioner was not present at the place of occurrence. The only material against the petitioner is that the JCB machine which had been used to demolish the wall belongs to the petitioner. 2025:JHHC:12156 2
6. It is the case of the petitioner that he used to give his machine on hire. 7. Considering the allegation and the material against the petitioner, it is a fit case where this application for anticipatory bail needs to be allowed. 8. Accordingly, this Anticipatory Bail Application stands allowed.
The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned ACJM, Ramgarh, in connection with Mandu (Kuju) P.S. Case No.170 of 2023, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property.
