For the State : Mr. Bhola Nath Ojha, A.P.P. …..... 07/15.04.2025 This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in a criminal case registered under Section(s) 399, 402, 170, 414 IPC, Sections 25(1-B)a, 26 and 35 of the Arms Act and under Sections 18, 22, 25 and 29 of the NDPS Act, in connection with Sadar P.S. Case No. 162 of 2024, pending in the Court of learned Sessions Judge, Chatra. Heard learned counsel for the petitioner(s) and learned APP for the State at length and gone through the documents annexed along with this application. It is alleged that on secret information regarding attempt to commit robbery, four persons were intercepted and from their possession, fire arms were recovered. The intercepted persons disclosed the names of their four escaped associates including this petitioner. They also disclosed that they have robbed opium, which was kept in Bolero Vehicle No. JH 05CX 5883 and from the said vehicle, 1.3 Kg opium was seized. Further from the record, I find that there are criminal antecedents against this petitioner. In view of the aforesaid facts, I am not inclined to allow this anticipatory bail application. Accordingly, the prayer for bail of the petitioner, above named, is rejected. However, if the petitioner surrenders, his case will be considered, considering the case of the similarly situated accused persons. Anu/-C.P.-3 (ANANDA SEN, J.)
