Applicant seeks Regular Bail in FIR No.21/2025 dated 11.01.2025, registered at P.S. Alipur, for commission of offences under Section 309(4)/3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Sections 392/34 IPC) 2. The abovesaid FIR was registered on the basis of the complaint made by one Sh. Dinesh Sharma, who revealed that on 08.01.2025, he had withdrawn cash from the account of the company and when he reached at Kheda Kalan Road, one bike came from behind, which was not carrying any number plate. There were two persons on the bike. Both the riders were wearing helmets and his bag was snatched, on the point of pistol. 3. The applicant was arrested on 16.01.2025 on the basis of one CCTV footage in which there was presence of his co-accused Vikram near the concerned Bank from where the money was withdrawn. Admittedly, the abovesaid co-accused Vikram is already on regular bail, albeit, he is not of the two bikers. The other biker i.e. Anji is on anticipatory bail on account of his medical condition. 5. Charge-sheet has already been filed but charges have yet not been framed. 6. Learned counsel for the applicant submits that accused has been implicated, merely, on his previous involvements. He submits that as per the averments appearing in FIR, since the alleged bikers were wearing helmets, there was no possibility for the complainant to have identified anyone. He submits that in FIR, it has nowhere been alleged that the complainant was in a position to identify any of the robbers. 7. Be that as it may, keeping in mind the overall facts of the case and without expressing any opinion over the merits of the case, the applicant is directed to be released on bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/CMM/Duty Magistrate with following conditions:- (i) The applicant would provide his Mobile Number to the concerned I.O and would ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court. (ii) The applicant would not try to come in contact of complainant and his family members, directly or indirectly. 8. The application stands disposed of in aforesaid terms.
