The petitioner has been made accused in connection with Special POCSO Case No. 25/2024 arising out of Bano P.S. Case No. 42/2024, for the offences registered under Sections 64, 88 & 89 of the B.N.S. 2023 and Sections 4 & 6 of the POCSO Act, pending in the Court of learned Sessions Judge-cum-Special Judge (POCSO), Simdega. 3. Petitioner is alleged to have established physical relationship with daughter of the informant, who is aged about 16 years. 4. Statement of victim was recorded during trial, in which she has stated that petitioner had established physical relationship with her. 5. Age of the victim is opined to be 16 years and her consent for physical relationship is immaterial. 6. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail.
