The present application u/s 528 BNSS has been filed with a prayer to issue a direction to the trial court to release the applicant in eight cases after submitting personal bond and two sureties, which are as as under :- (i) Case Crime No. 506 of 2023, under Sections 420, 406, 467, 468, 471 and 506 IPC, Police Station Bhojipura, District Bareilly. (ii) Case Crime No. 510 of 2023, under Sections 420, 406, 467, 468, 471 and 120B IPC, Police Station Bhojipura, District Bareilly. (iii) Case Crime No. 549 of 2023, under Sections 420, 406, 467, 468, 471, 506, 120B and 34 of IPC, Police Station Bhojipura, District Bareilly. (iv) Case Crime No. 279 of 2023, under Sections 420, 406, 467, 468, 471, 506, 120B, 34 and 504 IPC, Police Station Bhojipura, District Bareilly. (v) Case Crime No. 508 of 2023, under Sections 420, 406, 467, 468, 471, 506, 120B and 34 IPC, Police Station Bhojipura, District Bareilly. (vi) Case Crime No. 66 of 2024, under Sections 420, 406, 467, 468, 471, 506, 323, 504, 120B and 34 of IPC, Police Station Bhojipura, District Bareilly. (vii) Case Crime No. 535 of 2023, under Sections 316(2), 318(4), 338, 336(3), 340(2) BNS, Police Station Bhojipura, District Bareilly. (viii) Case Crime No. 541 of 2023, under Sections 420, 406, 467, 468, 471, 506 IPC and 120B of IPC, Police Station Bhojipura, District Bareilly. Learned counsel for the applicant submitted that last bail order in favour of the applicant is passed on 03.01.2025. It is further submitted that the applicant is a poor person. Applicant has no means to submit sureties as ordered in bail orders. Applicant has been roped up in eight cases in a row. It is further submitted that all the cases are same in nature. It is further submitted that all eight cases are related to Police Station Bhojipura, District Bareilly. It is further submitted that all the cases are related to agreement to sell to purchase of a piece of land in favour of the first informant but the applicant is not executing the sale deed in favour of the first informant. It is further submitted that applicant is languishing in Jail since 27.08.2024. It is further submitted that applicant has been granted bail in all eight cases by this court and co-ordinate Bench of this Court. In view of the above facts and circumstances, the concerned Magistrate / Court is directed to release the applicant in all eight cases related to Police Station Bhojipura, District Bareilly, on the basis of personal bond of Rs.1,00,000/- and two sureties of like amount to the satisfaction of court concerned.
