ORDER; The present Writ Petition is filed questioning the action of the Respondent No. 2 in not considering the Petitioner’s representation dated 12.05.2025 wherein the Petitioner sought for compensation for an extent of Ac.2.77 cents in Sy.No.276B/1B and Ac.0.50 cents in Sy.No.276B/1A, totaling to Ac.3.27 cents of Bandameeda Kammapalli Revenue Village, Madanapalli Mandal, Annamayya District as illegal and arbitrary.

The Petitioner claims right over the schedule property under Registered Partition Deed dated 19.08.1930 vide Doc.No. 140/1930, which was followed by another Partition Deed dated 14.09.1944 vide Document No. 1989/1944. Thereafter, subsequent document relied on by the Petitioner is a Registered Will dated 24.01.2019 executed by his father in favour of the Petitioner.

Learned counsel for the Petitioner submits that the land referred above was being used for the purpose of vegetable market by the Respondent Authorities without paying compensation or issuing TDR for the land in question. In that context, the Petitioner gave a representation
A'- 3 on 12.05.2025 to the Respondent Authorities, but no action has been taken on the said representation till now. Therefore, the Petitioner filed the present Writ Petition.

Learned Standing Counsel for the Respondent Municipality passed on the Written Instructions signed by the Commissioner, Madanapalle Municipality and submitted that a repiy was issued on 21.05.2025 through the learned Standing Counsel for Madanapalle Municipality on the instructions of the Respondent Authorities denying the claim of the Petitioner. It was mentioned in the reply notice that the property was vested with the Government since time immemorial and therefore, the Petitioner cannot claim for any compensation .
5. As there is a denial of claim of the Petitioner by the Respondent Authorities over the subject property, this Court is of the opinion that the Petitioner can agitate these aspects in a properiy instituted suit rather than pursuing this Writ Petition.
6. With the above observation, the Writ Petition is disposed of. Liberty is given to the Petitioner to pursue his civil remedies before appropriate forum. There shall be no order as to costs.
