Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol, Mr. Vishal Panwar & Mr. B.C. Verma, Additional Advocate Generals, with Mr. Ravi Chauhan, Deputy Advocate General, for the non- applicants/respondents. While placing on record communication dated 25.09.2025, issued under the signatures of Executive Engineer, Arki Division, HP PWD, Arki, Mr. Vishal Panwar, learned Additional Advocate General, states that respondents, after having considered the case of the petitioner, in light of mandate contained in the judgment, alleged to have been violated, have rejected the case of the petitioner. Having carefully perused aforesaid communication as well as copy of office order dated 06.06.2025, enclosing therewith, which are taken on record, there appears to be merit in the afore contention of learned Additional Advocate General. Since there was only direction to the respondents to consider and decide the representation of the petitioner and respondents, after having considered the case of the petitioner in light of observations made in the judgment, alleged to have been violated, have already rejected the representation, no action of the respondents can be said to be contumacious. In view of the above, present application is disposed of reserving liberty to the petitioner to file appropriate proceedings in appropriate Court of law, laying therein challenge to order passed in purported compliance of the judgment, alleged to have been violated.
