UNNI KRISHNAN NAIR 21.03.2025 (Vijay Bishnoi, CJ) The matter comes upon for consideration of this Interlocutory Application [I.A.(Civil) No.3560/2024] with a prayer to condone the delay of 229 days occasioned in filing the connected writ appeal. Though Mr. J. Patowary, learned counsel appearing for the sole respondent has opposed the application by filing affidavit, however, looking to the fact that the sole respondent was removed from the service on the ground of his conviction in a criminal case where he was sentenced to undergo Rigorous Imprisonment for a period of 7(seven) years with fine for the offence punishable under Section 436/34 of Indian Penal Code (IPC), we are of the view that the matter requires consideration on merits. Hence, the application is allowed and the delay of 229 days in filing the connected writ appeal is condoned. Registry to register the connected writ appeal immediately and list the same for admission on 26.03.2025. This Interlocutory Application is accordingly disposed of.
