GP FOR HOME (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.13794 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents, particularly respondents 3 and 4, at the instance of 5th respondent, in repeatedly insisting the petitioners to appear before their authority and yield to the terms of 5th respondent in connection with civil disputes connected to agricultural landed property of Ac. 0.91 1/2 cents, Ac. 0.04 1/2 cents and Ac. 0.06 cents respectively covered by Re. Survey Number 696/10B, 696/9B and 696/9A all together Ac. 1.02 cents of Penuganchiprolu Revenue Village and Mandal, Krishna District, as illegal, irregular, irrational, arbitrary, without any authority of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents rot to interfere in any manner with the petitioners' life, liberty and said properties and pass…” 2. None appeared for the petitioners. 3. Learned Assistant Government Pleader for Home on written instructions would submit that the respondents did not call the petitioners as alleged in the writ petition. Their preliminary enquiry would reveal that civil suits are pending before the Civil Court, and it is a matter relating to civil dispute, and therefore, they will not interfere in this matter in accordance with law. 4 4. The allegations of the writ petitioners are that police are interfering in civil dispute without following due procedure established by law. 5. In the light of submissions made by the learned Assistant Government Pleader for Home on written instructions, it would clear that the matter is of civil in nature, and police will not interfere in such matters. 6. In that view of the matter, nothing remains for further adjudication in the writ petition, and the writ petition is liable to be dismissed as infructuous, at the stage of admission, without going to merits of the case. 7. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
