This is an application filed by the petitioners praying for grant of anticipatory bail in terms of sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023, as the petitioners have been allegedly implicated in connection with Sindri PS case no. 114 of 2020 registered for the offences punishable under sections 147, 148, 149, 341, 323, 324, 353, 307,120B, 188, 268, 379, 269, 270, 271 of the IPC & Section 3 of Prevention of Damage to Public Property Act, 1984, pending in the court of learned J.M, 1st, Class, Dhanbad. 2. Heard the learned counsel for the petitioners, learned counsel appearing on behalf of the State. 3. The learned APP opposes the prayer for anticipatory bail of the petitioners. 4. It is alleged that petitioners and others took part in an agitation. From Annexure-2, it appears that the petitioners have appeared before the Investigating Officer on 6.5.2025 and has furnished written statement, this suggests that the petitioners are cooperating with the investigation. Once the petitioners have appeared before the Investigating Officer pursuant to the notice under Section 35(3) of BNSS, there should not be any apprehension that the petitioners will be arrested. 5. Considering the aforesaid facts, I am inclined to release the petitioners on anticipatory bail. Accordingly, the petitioners, above named, are directed to surrender before the court below within four weeks from today and in the
2025:JHHC:21511 event of their surrender/arrest the learned court below is directed to enlarge them on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M, 1st Class, Dhanbad, in connection with Sindri PS case no.
114 of 2020, subject to the condition that one of the bailers should be close relative of the petitioners and other should be a resident of State of Jharkhand, having sufficient landed property in their name or in the name of their ancestors in which they are having share and to that effect, they have to file an affidavit before the learned trial court indicating them to share in the property. 6. The petitioners should cooperate, join the investigation and appear before the Investigating Office once in fifteen days till completion of investigation. (ANANDA SEN, J.)
