This is an application under Section 483 of the BNSS, 2023, wherein the petitioner, namely Diluwar Hussain, has prayed for grant of bail in connection with Sessions Case No. 279(DM)/2023 arising out of Dalgaon P.S. Case No. Page No.# 2/2 244/2023 under Sections 448/302 of the IPC. The allegation brought against this petitioner is that he has stabbed his father to death. There are nine witnesses shown in the charge sheet as prosecution witnesses, out of which three are already examined. I have gone through their evidence. The petitioner has already spent 610 days in judicial custody. He is being represented by the Legal Aid Counsel. Considering all the facts, this Court is of the opinion that the petitioner deserves to be released on bail. Accordingly, the petitioner, Diluwar Hussain, who is facing trial in Sessions Case No. 279(DM)/2023, pending in the Court of learned Sessions Judge, Darrang, Mangaldai, is allowed to go on bail of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Sessions Judge, Darrang, Mangaldai. The petitioner is directed to appear before the learned Trial Court on each and every date without fail. If the petitioner defaults in appearance, liberty is given to the learned Trial Court to procure his attendance. With the aforesaid observation, the bail application is disposed of.
