GP FOR REVENUE The Court made the following: :: ORDER :: The above writ petition has been filed impugning the proceedings issued by respondent No.4 in O.P.No.14 of 2024 dated 09.04.2025 cancelling the registered gift deed Nos.4413/2022 & 4414/2022 dated 06.05.2022 executed by respondent No.5 in favour of 1st petitioner in respect of land of an extent of Ac.1.63 cents in Sy.Nos.560-1, 561 & Ac.2.00 cents in Sy.Nos.543- 1D4A respectively, situated at Karumanchi H/o Vayakallu Village, Savalyapuram Mandal, as illegal and arbitrary. Heard Sri Kotha Rama Mohan Rao, learned counsel for the petitioners and Sri Bhagat Singh, learned Assistant Government Pleader for Revenue, appeared for respondents 1, 3 & 4 and Smt. Swapna Priya, learned Assistant Government Pleader for Social Welfare, appeared for respondent No.2. Notice of respondent No.5 is dispensed with since no adverse orders are passed against the right and interest of respondent No.5. 3. Sri Bhagat Singh, learned Assistant Government Pleader, submitted the instructions of the Revenue Divisional Officer, Narasaraopet. A perusal of said instructions would indicate that a revised order dated 19.05.2025 was passed, since the document numbers are wrongly recorded in the original order. 4. Learned counsel for the petitioner would submit that the order dated 19.05.2025 has not been communicated to the petitioner, and he came to know about the order, on perusal of the instructions submitted by the learned Assistant Government Pleader for Revenue across the bar. 5. Learned counsel for the petitioner seeks permission of this Court to withdraw the present writ petition with liberty to file a fresh writ petition. 6. Permission is accorded. 7. Given the facts and circumstances of the case, the Writ Petition is dismissed as withdrawn, giving liberty to the petitioner to file a fresh writ petition. No order as to costs.
