Anand for the petitioner Sri Jai Bhagwan, who has filed this petition under Section 523 of Bharatiya Nagarik Suraksha Sanhita, Page No.# 2/3 2023 with prayer for zimma of the vehicle bearing registration No. HR-46F-4203 (Goods Carrier-HGV) seized in connection with Gossaigaon Police Station Case No. 127/2024 under Section 20(C)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. It is submitted that the petitioner is not the accused in connection with the aforementioned case. 3. Heard Mr. B. Sarma, learned Additional Public Prosecutor, Assam, who has submitted that a report has been forwarded by the Officer-In-Charge of Gossaigaon Police Station. 4. Seen the report of the Officer-In-Charge of Gossaigaon Police Station that charge sheet has been submitted against the accused persons Sulendra Kumar, Bante Kumar and Durbin Singh vide Gossaingaon PS CS No. 142/2024 dated 31.10.2024 and the vehicle seized in connection with this case being Gossaigaon Police Station Case No. 127/2024 is no more required by the Investigating Officer for further investigation. 5. I have considered the submissions. 6. It is submitted that the petitioner is the Power of Attorney Holder of the vehicle. It is further submitted that the vehicle is in the premises of Gossaigaon Police Station. 7. As the vehicle is not required for further investigation, the Officer-In- Charge of Gossaigaon Police Station may hand over the vehicle to the registered owner after proper verification of the documents and after ascertaining the Page No.# 3/3 ownership of the vehicle subject to the conditions that an undertaking is executed by the registered owner to produce the vehicle as and when required by the Court, for an amount of Rs.10,00,000/- (Rupees Ten Lacs) and not alienate the vehicle, till conclusion of trial. 8. The report of the O/C will form a part of this order. 9. In terms of the above observation, this petition stands disposed of. JUDGE Comparing Assistant
