1. The State Of Rajasthan, Through Principal Secretary, School Education, Secretariat, Jaipur.
2. The Director Secondary Education, Bikaner, Raj.
3. The Joint Director, School Education, Bikaner Division, Churu, Raj.
4. The District Education Officer (Headquarter), Churu, Raj. ----Respondents For Petitioner(s) : Mr. Sandeep Garssa For Respondent(s) :
HON'BLE MR. JUSTICE SUDESH BANSAL
Order 30/05/2025
1. The case of petitioner is that after according promotion from the post of Vice Principal to Principal, vide order dated 25.01.2025, he was allowed to join at previous place of posting i.e. Baijnath Bhartiya Government Senior Secondary School, Ratangarh, District- Churu, however, later on, vide order impugned dated 12.04.2025, he has been posted at Government Senior Secondary School, Ballar Khajuwala, District- Bikaner.
2. Indisputably, earlier petitioner, challenging the posting order dated 12.04.2025, had filed one writ petition, which came to be
disposed of vide order dated 28.04.2025, permitting the petitioner to submit representation. In pursuance thereof, petitioner
[2025:RJ-JP:22725] (2 of 2) [CW-8699/2025] submitted a representation before the respondents, which has been rejected vide order dated 23.05.2025.
3. This Court finds that the cause of action which has been raised in the present writ petition is similar to that, which was raised in the previous writ petition and second writ petition, involving similar cause of action, can only be filed by petitioner when the liberty is granted to the petitioner, while deciding the previous writ petition. A copy of order dated 28.04.2025, deciding the previous writ petition dated, has not been shown by counsel for petitioner that any liberty was granted or not?
4. In such view of the matter, counsel for petitioner, after arguing for some time and having instructions of petitioner, seeks permission to withdraw this writ petition.
5. Permission is granted.
6. Accordingly, the writ petition is dismissed as withdrawn.
7. Stay application and pending application(s), if any, stand
disposed of.
