The instant bail application has been preferred by the petitioner for grant of regular bail in connection with Sadar Daltonganj PS Case No. 39 of 2025 corresponding to Special POCSO Case No. 35 of 2025, registered for the offence under Sections 65(1) of Bharatiya Nyaya Sanhita 2023 and under Section 4 of POCSO Act Pending in the Court of learned Exclusive Special Judge (POCSO), Palamau at Daltonganj. 3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is languishing in jail custody since 08.04.2025 as such, the petitioner may be enlarged on bail. 4. Learned APP opposes the prayer for bail. 5. Having regard to the gravity of the offence and the allegation against the petitioner, I am not inclined to enlarge the petitioner on bail at this stage.
