This Anticipatory Bail Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023, has been filed by the petitioner apprehending his arrest in connection with Jogta P.S. Case No.12 of 2024, for offence under Section 379 IPC. The case is presently pending before the Court of learned Chief Judicial Magistrate, Dhanbad.
2.
Heard the parties at length.
3.
Learned counsel representing the petitioner submits that the petitioner is not named in the F.I.R. and there is nothing to implicate this petitioner in this case. He further submits that no incriminating article has been recovered from the possession of the petitioner, rather he is cooperating in the investigation.
4.
Learned Spl. A.P.P. representing the State opposes the anticipatory bail application, and after going through the impugned
order submits that there are six criminal cases pending against this petitioner.
5.
The allegation in the F.I.R. is that the informant party detected that the water supply pipes were cut down and stolen. In
2025:JHHC:12326 2
the impugned order, learned Trial Court giving reference to the case diary, has found that the pipes were recovered from the godown of this petitioner.
6.
Considering the fact that the petitioner has criminal antecedents and the pipes were recovered from the godown of the petitioner, it is not a fit case for grant of anticipatory bail.
7.
Accordingly, this Anticipatory Bail Application stands dismissed.
