By way of instant application filed under Section 5 of the Limitation Act, prayer has been made on behalf of applicant/appellant for condonation of delay of 46 days in maintaining the accompanying appeal, which is barred by limitation. Having perused averments contained in the application, which is duly supported by affidavit, this Court is convinced and satisfied that delay in maintaining the accompanying appeal is neither intentional nor deliberate, rather same has occurred on account of the circumstances, which were completely beyond the control of the applicant/appellant and as such, delay in filing the appeal, which in our considered view has been sufficiently explained, is condoned. The application stands disposed of. Cr.MP(M) No.__________ of 2025 [Cr.MPMST No. 6689 of 2025] Heard. Leave to appeal granted. Application stands disposed of. Cr. Appeal No._________ of 2025 Be registered. Admit. Bailable warrants in the sum of Rs.25,000/- with one surety in the like amount to the satisfaction of the Arresting Police Officer be issued against the respondent, undertaking to appear in this Court as and when directed to receive any sentence, which may be imposed on the conclusion of the appeal.
