Perused the record. 3. Applicant-Sandeep, who is the first informant, has approached this Court by means of present application under Section 528 BNSS with the following prayer:- "It is, therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased to allow this present application and to quash the order dated 20.08.2024 passed by District & Sessions Judge, Baghpat whereby application no. 7B moved by the applicant has been dismissed and allow the application no.7B filed by the applicant in S.T. No. 92 of 2024 (State V. Vivek Chauhan @ Manish etc.) arising out of Case Crime No.842 of 2023 under sections 302, 201, 120B, 34 I.P.C. Police Station Baghpat, District Baghpat. It is further prayed that during the pendency of present application before this Hon'ble Court the further proceedings of S.T. No. 92 of 2024 (State V. Vivek Chauhan @ Manish etc.) arising out of Case Crime No.842 of 2023 under sections 302, 201, 120B, 34 I.P.C. Police Station Baghpat, District Baghpat pending in the Court of Sessions Judge, Baghpat may kindly be stayed. And/or pass such order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case." 4. After some arguments, the learned counsel for applicant fairly submits that applicant does not wish to press this application. He, therefore, contends that present application be dismissed as withdrawn. 5. Learned A.G.A. for State opposite party-1 and Mr. Swetashwa Agarwal, the learned counsel representing opposite parties 2, 3 and 4 have no objection to the prayer made by the learned counsel for applicant. 6. In view of above, the present application u/s 528 BNSS is accordingly dismissed as withdrawn. 7. Interim order, if any, stands vacated.
