JUSTICE MRIDUL KUMAR KALITA ORDER 22.10.2025 1. Heard Mr. J.P. Baishya, the learned counsel for the petitioner. Also heard Ms. A. Khasnobish, the learned counsel for the respondent. 2. This application under Section 24 of the Code of Civil Procedure, Page No.# 2/3 1908 has been filed by the petitioner, namely, Sanchita Rani Roy, praying for transfer of Title Suit (Divorce) Case No. 71/2024 from the Court of the learned District Judge, Hailakandi, to the Court of the learned Principal Judge, Family Court, Cachar, Silchar. 3. The aforesaid suit was filed by the respondent seeking divorce from the present petitioner. 4. The learned counsel for the respondent submits that since the marriage between the petitioner and the respondent was performed at Silchar, the Courts at Silchar also have jurisdiction to try the aforesaid case. 5. She further submits that the respondent does not have any objection, if the aforesaid Title Suit (Divorce) Case No. 71/2024 is transferred from the Court of the learned District Judge, Hailakandi to the Court of the learned Principal Judge, Family Court, Cachar, Silchar. 6. Considering the submissions made by the learned counsel for both the parties, more particularly, the fact that the respondent is not opposed to the prayer for transfer of the aforesaid to the Family Court, Cachar, Silchar. 7. This transfer application is allowed. 8. The learned District Judge, Hailakandi is directed to transfer the records of Title Suit (Divorce) Case No. 71/2024, to the Family Court, Cachar, Silchar. 9. As both the parties are represented by their engaged counsel Page No.# 3/3 before this Court, they are directed to appear before the Family Court, Cachar, Silchar on 28th November, 2025. 10. Before the aforesaid date, the learned District Judge, Hailakandi shall ensure that records of the aforesaid case, which is the Family Court, Cachar, Silchar, in pursuant to the directions given hereinabove. 11.
