1. Prayer is for grant of anticipatory bail to the petitioner under Section 482 of BNSS, 2023 in criminal case having FIR No.04 dated 03.01.2017 registered under Sections 279, 304-A, 337, 429 of IPC and Section 11 of Prevention of Cruelty to Animals Act, 1960 and Section 13(1) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at Police Station Sadar Dadri, District Bhiwani. 2. On 03.02.2025, following order was passed:
“Prayer is for grant of anticipatory bail to the petitioner under Section 482 of BNSS, 2023 in criminal case having FIR No.04 dated 03.01.2017 registered under Sections 279, 304-A, 337, 429 of IPC and Section 11 of Prevention of Cruelty to Animals Act, 1960 and Section 13(1) of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015 at Police Station Sadar Dadri, District Bhiwani. Counsel for the petitioner inter alia submits that petitioner, who was not named in the FIR is later on falsely impleaded as accused in the present case on the basis of some disclosure statement suffered by co-accused Kamaluddin. Counsel for the petitioner further submits that at the time of alleged incident, the present petitioner was not driving vehicle in question which as AJAY GOSWAMI 2025.05.13 15:25 I attest to the accuracy and integrity of this document
CRM-M-6260-2025 (O&M) -2- per prosecution, turned turtle which resulted into death of one of its occupant namely Mustaaq and three cattle which were being illegally transported in the said vehicle. Counsel for the petitioner further submits that the petitioner never received any notice/summons/warrants with regard to the present case and is ready and willing to join investigation with the police. Notice of motion. Mr. Arjun Lakhanpal, Addl.A.G., Haryana accepts notice on behalf of the State and submits that it was the present petitioner, who was driving the offending vehicle which resulted into death of one human being and three cattle. It is further submitted that in the meantime, the petitioner managed to escape from there and is required by the police for the purpose of proper investigation of the case.
However, the State counsel submits that till date the petitioner is not declared as proclaimed person despite the fact that FIR in this case was registered about 8 years back. In view of the fact that the petitioner was not named in the FIR and nominated as accused on the basis of disclosure statement of co-accused, which is subject matter of trial Court, the petitioner is hereby directed to join investigation with the police and in case of arrest, he is directed to be released on interim bail by the IO/Arresting Officer to his own satisfaction till the next date of hearing. The petitioner is to abide by the conditions as envisaged under Section 482(2) of BNSS, 2023. Now be listed on 13.05.2025.”
3. Learned State counsel has filed status report by way of affidavit of Dinesh Yadav, HPS DSP Charkhi Dadri. Same is taken on record. Be tagged at the appropriate place. Learned State counsel further on instructions from SI Vishal, submits that in compliance of order dated 03.02.2025 passed by this Court, the petitioner has joined the investigation and is not required for further custodial interrogation. 4. Keeping in view the statement made by learned State Counsel the order dated 03.02.2025, is made absolute. The petitioner shall abide by the terms and conditions enumerated in Section 482(2) of BNSS, 2023. 5. The petition is accordingly disposed of. (HARPREET SINGH BRAR) 13.05.2025
