Mr. Janesh Mahajan, Standing Counsel, for the respondent. The applicant had moved Cr.MP No.2789/2024 in Cr.MP(M) No.2820/2022 for release of his passport to visit Canada. The application was allowed on 07.11.2024 subject to certain terms & conditions including applicant’s furnishing bank guarantee for an amount of Rs.30 lakhs to the satisfaction of learned Trial Court and subject to surrendering his passport before the learned Trial Court on expiry of eight weeks period from the date of release of passport. The petitioner seeks release of his bank guarantee on the ground that he has complied with all terms & conditions imposed upon him under order dated 07.11.2024. On being put to notice, non-applicant-respondent has filed reply and has admitted the compliance of all imposed conditions by the applicant as also the fact that after performing the journey in question, applicant had surrendered his passport before the learned Trial Court on 23.05.2025 In view of above, the application is allowed.
