When there was a contest between the petitioners and respondent no.5, the First Information Report under Sections 419, 420, 467, 468 and 471 IPC was lodged by the respondent no.4, which resulted in Case Crime No.0021 of 2023. 2. Since, it was a contest between the brothers, who are petitioners and the respondent no.5, who is their sister, this Court on 4.12.2024 referred the matter to the Mediation Centre, Allahabad. 3. On 25.01.2025, the parties entered into a compromise and Settlement Agreement was drawn by the mediators. The paragraph 8 of that Settlement Agreement is important and so is reproduced hereinbelow:- "8. पकककरर कक मधय मम ननमनलललखत समझझतक समपन हहआ हह। क. यह नक सभभ पकककर मधयसथतक मम उपससथत हहए तथक उनकक कथन हह नक पकककरर नक आपसभ सहमनत सक अपनक नववकद कक पहलक हभ इस शतर पर ससलझक ललयक हह नक यकनचकककतकरगण र. 50,00,000/- ( पचकस लकख रपयक मकत) कक धनरकनश शभमतभ पसषपक शसकलक ( पनतवकनदनभ सस. 5) कक नडमकणड डडकफट कक जररयक अदक करमगक। ख. यह नक पकककरर नक यह कथन नकयक हह नक यकनचकककतकरगण उपरकक तय धनरकनश अथकरतत र. 50,00,000/- ( पचकस लकख रपयक मकत) शभमतभ पसषपक शसकलक ( पनतवकनदनभ सस. 5) कक नडमकणड डडकफट कक जररयक पहलक हभ अदक कर दभ हह लजसकक पकनप ( पनतवकनदनभ सस. 5) नक ससननसशचत कक हह। ग. यह नक पकककरर कक मधय यह भभ तय हहआ हह नक उपरकक तय धनरकनश शभमतभ पसषपक शसकलक ( पनतवकनदनभ सस. 5) कक पकप हक गयभ हह अतत पकककरर कक मधय अपरकध सस. 0021 of 2023 मम अब ककई दकवक, नववकद, मकमग व दकनदकरभ एक ददसरक कक पनत शकष नहभ हह। घ. यह नक पकककरर कक मधय यह भभ तय हहआ हह नक पकककर एक सपकह कक मधय इस समझझतक कक पनत ककनपसर नवककस पकलधकरण, ककनपसर कक ससबसलधत ककयकरलय मम पकप करकयमगक। ड. यह नक पकककरर कक मधय यह भभ तय हहआ हह नक शभमतभ पसषपक शसकलक ( पनतवकनदनभ सस. 5) कक नकसभ भभ तरभकक सक ककई आपलत नहभ हकगभ यनद इस समझझतक कक पककश मम मकननभय उचच नयकयकलय Criminal Misc. In view of the settlement agreement, the parties had agreed that criminal cases which were pending viz-a-viz petitioners and respondent no.5 would be withdrawn. 5. Under such circumstances, the first information report dated 24.02.2023, registered as Case Crime No.0021 of 2023, under Sections 419, 420, 467, 468 and 471 IPC is quashed. The writ petition is allowed. 6. This order is passed in the presence of Sri Sahibe Alam, learned counsel for the petitioners, Ms. Shubhanjali Gupta, holding brief of Sri Anand Prakash Paul, learned counsel for the respondent no.4 and Sri Anurag Mishra, learned counsel for the respondent no.5.
