V. Sri Ramani, W/o N. Nagarjuna, aged 47 years, resident of Pragathi .Bhavan, Kakinada, and serving as project Director, DRDA, Kakinada, lodged a report stating that Accused No.1/D.Padmakumari, Village Organization Assistant of` B.Kothuru VI-Ilage, and Accused No.2/Branch Manager of Bank of Baroda, Pithapuram, in collusI'On, Created 168 duplicate self Help Groups (141 in B;nk of Baroda and 27 in DCCB Pithapuram) between the years 2018 and 2024. These groups were fraudulently formed using fake documents of indI'VI'dualS residing Outside the COnCerned mandal and district, in violation of SHG guidelines.It is further alleged that Accused No.1 and Accused No.2, acting with common intention, misappropriated approximately Rs.10.21 crores under the guI-Se Of SHG-linked loan disbursements from Bank of Baroda, Pithapuram. AdditI-Onally, Accused No.3/M.R. Meenakshi, Community Coordinator of P.Thimmapuram CIuster, is reported to have improperly joined Kanakadurga SHG as a member, which is in direct contravention of SERP HR Terms and Conditions. Based ton the findings of the District Project Manager's enquiry report, actI-On Was sought against the individuals involved in the said misappropriation. 3. Heard learned counsel for the petitioner and the learned Assistant public prosecutor. perllsed the record. / #', t`J-I. :_i 4. Sri N.Ranga Reddy, Ieamed counsel for the petitioner, submits that the petitioner is the sole bread winner of her family'. The Petitioner has not committed any offence and she was falsely`implicated in this case. The Petitioner would abide by any condition to be imposed by this court. 5. Per `cor,ira, Mr. Neelotphal Ganji, the learned Assistant Public prosecutor, opposed in granting of bail stating that the some more material witnesses have to be examined; investigation is not completed; if the petitioner is.enlarged 6n bail, she would not be available for the investigation and she would escape from the clutches of law; and urged to dismiss the bail petition, 6. The petitioner is being a coinmunity coordinator of P.Thimmapuram CIuster, herself joined as a member in Kanakadurga Self Help Group wh.ich is cont.rary to SERP HR Terms and Conditions. She has not indulged in the activity of breach of trust as contemplated under section 409 of lthe I.P.C.,I/Section 316(v) of the Bharatiya Nyaya Sanhita, 2023 (for brevity lthe BNS'). The Petitioner is a Government Servant and she was also placed under Suspensio.n as per the report lodged by the de-facto complainant. The petitioner is a female and having two children. Considering the entire gamut of the case, the prayer of the Petit-loner is convincing and reasonable.In view of the above facts and .circumstances of the case, this court is inclined to consider the request of Pet'ltioner for grant of anticipatory bail. 7.
