was dismissed. Being aggrieved by the same, the petitioner has approached this Court in this writ petition.
2. The plaintiff has filed a suit for declaration. PW-1 has adduced evidence. The defendants have cross-examined the PW-1 and evidence of defendants is also completed. At this stage, the plaintiff has filed an application for reopening the case for further evidence of the plaintiff, PW-1. The trial Court has rejected the application on the ground that the matter is posted for arguments and the application has been filed at a belated stage.
3. Be that as it may. The evidence of the parties has been completed and the matter is posted for arguments before the trail Court. At this stage, the plaintiff has filed an application for reopening the case for further evidence of the plaintiff. Under these circumstances and in the interest of justice, I am of the opinion that the writ petition is liable to be allowed on imposing exemplary cost on the petitioner payable to the defendants.
