This is First bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 46/2025 registered at Police Station – Gourela, District – Gourela-Pendra-Marwahi (C.G.) for the offence punishable under Section 314, 317(2), 317(4), 61(2)(a), 112 BNS.
2. As per prosecution story in brief is that the Assistant Sub Inspector Manoj Kumar Hanotiya made a written complaint on the information received from Bhartiya Cyber Apradh VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.06.24 10:28:05 +0530
2 Samanvay Kendra (14C), that through various branches of bank situated in District Gourela-Pendra-Marwahi (C.G.), many mule bank account has been created between date 01.01.2024 to 31.01.2025, which has been used to commit cyber crime and get the amount in it which is total Rs. 50,900/-.

Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case. It is submitted by learned counsel for the applicant is that the charges leveled against him just in order to harass him, he had no such bank accounts which can be operated as mule account nor his identity proof has been used with his consent to open any account in any of the bank branches to earn any kind of profit. He also submits that the present applicant is in jail since 03.04.2025 and conclusion of the trial may take some time, therefore, she prays for grant of regular bail to the present applicant.

On the other hand, learned State counsel, opposes the bail application and submits that applicant is a resident of the State of Rajasthan and there is no previous antecedent against the applicant but the present case is of the nature of online fraud, by which the complainants suffered of huge amount. Thus, the bail application deserves to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.

6. Considering the facts and circumstances of the case,
submissions of learned counsel for the parties, nature of dispute and material available in the case diary, it transpires that the present case is of the nature of online fraud, by which the complainants suffered loss of huge amount and he is in jail since 09.04.2025, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on bail.
7. Accordingly, this second bail application of applicant – Ajay Meena involved in Crime No. 46/2025 registered at Police Station – Gourela, District – Gourela-Pendra-Marwahi (C.G.) for the offence punishable under Section 314, 317(2), 317(4), 61(2)(a), 112 BNS. is rejected at this stage.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
