ORDER:
ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhi{a, 2023, has been filed by the petitioner/A3, seeking bail, in Crime No.27/2024 of Annavaram Police Station, Alluri Sltharama+ Raju District.
2. The above said crime was registered against the petitioner/A3 herein and others for the offences punishable under sections 20(b)(ii)(C), 25 read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short fthe NDPS ActJ).
3. The case of the prosecution is as foI`Iows: On 28,6.2024 at about 10.00 hrs near Rallagedda Kappagondi Junction, Balapam Panchayat, Chintapalli MandaI, AIIuri Sitharama Raju District, the Sl of Annavaram police station, on credible information about illegal transportation of ganja, secured the presence of inediators and rushed to the above place and found seven persons. On seeing police, they tried to escape from the spot. But the police caught four persons and three persons escaped while the other was apprehended. Later, they were marked as A1, .A4, A5 and A6, On questioning, the accused disclosed their identity particulars. On search found 151.66kgs of dry ganja, seized the same and arrested the accused and sent to judicial custody. on the confession of the above accused, the petitioner was arrestecl on 06.5.2025- `-. -..`
4. Learned counsel fOrt'he Petitioner COntended that On the confession of other accused, the petitioner was arrested on 06.5.2025 and since then he has been in judicial custody. Learned counsel for the Petitioner also submits that this court granted bail to Al v,'de Crl.P.No.6484 of 2024 and prays to enlarge the petitioner on bail.
5. On the other hand, learned Assistant Public Prosecutor confirms non-filing of charge sheet by the police and opposed for grant of bail to the petitioner. He further submitted that there are nO PreV|lOuS antecedents against the petitioner.
6. Heard both sides. Perused the entire mater'lal on record.
7. Considering the submiSSiOnS and On Perusal Of the mater'lal On record, this court has carefully gone through the material placed on record. The mediators report Shows that the Case Came tO be registered against the petit-loner basing on the confession of co-accused and no incriminating material has been collected to show the involvement Of the petitioner in the commission of offence and also considering the
submissions made by the learned Assistant Public Prosecutor that according to his instructions no antecedents have been reported against the petitioner and also the pet'l{ioner is a permanent resident of Balapam panchayat, there is no credible apprehension Of h'Im fleeing away from justice. Additionally, since most Of the Witnesses are Official Witnesses, the release of the petitioner would not impede the investigation or tamper z+c+rfz~
with the evidence. Hence, considering the nature of allegations, this court feels that further detention of the petitioner is not required. In the said
facts of the case, this court is inclined to grant bail to the petitioner.
10. In the result, the criminal petition is allowed with the following conditions: i. The petitioner/A3 herein shall be released on bail on his executing a personal bond for Rs.20,000/-(Rupees twenty thousand only) with two (02) sureties for a like sum each to the satisfaction of the learned Special Judge for Trial of Cases under NDPS Act-Gum-I Additional Sessions Judge, Visakhapa{nam; ii) After release, the petitioner shall appear before the station House Officer concerned, on every sunday between lO.OOam to 01.OOpm for a period of three (03) months or till filing of charge sheet, whichever is earlier; and iii) that the petitioner is directed not to hamper the investigation and tamper with the prosecution witnesses.
