JUSTICE PRAVEER BHATNAGAR Order 20/08/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.05/2025 registered at Police Station Khetri, District Neem Ka Thana for the offence(s) under Sections 85 and 80(2) of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that prima-facie, the offence under Section 108 of BNS is not made out against the petitioner. There is no evidence to the fact that soon before the death of the deceased, she was instigated and due to instigation of the petitioner, she committed suicide. The Investigating Agency after thorough investigation in the charge-sheet at point No.9 stated that the deceased [2025:RJ-JP:32718] (2 of 2) [CRLMB-7210/2025] committed suicide in rage as the petitioner restrained him not to call her parents. The petitioner is in custody since 05.01.2025. The charge-sheet has already been submitted and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. Considering the arguments advanced by learned counsel for the petitioner and after going through the point No.9 of the charge-sheet submitted by the Investigating Agency, I deem it just and proper to enlarge the accused-petitioner on bail. 6.
