The Court made the following Order:
1. The learned counsel for the petitioners submits that the petitioners are constructing a house on land admeasuring Ac.0.57 cents. The 3rd respondent, who is a former Sarpanch of Panchadarla Village, Rambilli Mandal, Anakapalli District, has been interfering in the construction activity.
2. It is alleged that the 2nd respondent, at the behest of the 3rd respondent, has been pressurizing the petitioners to settle with the 3rd respondent, and that the 2nd respondent has stalled the construction activity of the petitioners.
3. The learned Assistant Government Pleader, on instructions, submits that the 3rd respondent has filed a complaint dated 10.06.2025. In that regard, the petitioners were called to the police station for enquiry purposes only. It is also stated in the written instructions that the police are not interfering in the construction activity. It is further stated that after completing preliminary enquiry, the police have concluded that a civil dispute exists between the petitioners and the 3rd respondent.
4. Recording the same, it is made clear that the 2nd respondent shall not interfere with the construction activity without following the due process of law. Accordingly, the writ petition is disposed off. There shall be no order as to costs.
