Mr. Sanjay Jaswal, Advocate, for the respondent. CMP No. 18065 of 2025 Heard counsel for the parties. Perused the application and the previous orders passed. Vide order dated 11.04.2025, passed in CMP No. 6054 of 2025, 50% of the amount deposited as use and occupation charges alongwith proportionate interest accrued thereupon had been ordered to be released in favour of the present respondent. On the said date total amount deposited in the Registry of this Court alongwith proportionate interest as use and occupation charges by the applicant/respondent was ₹2.64 Lakhs. 50% of the same has been released. Subsequent thereto an amount approximately ₹1.34 Lakhs was deposited as use and occupation charges by the present appellant/non-applicant. Hence, as on date total amount lying deposited in the Registry of this Court as use and occupation charges is ₹1.34 Lakhs + ₹1.34 Lakhs by the non-applicant/appellant. In the aforesaid facts and attending circumstances, let 50% of the aforesaid amount which stands deposited in the Registry of this Court be released in favour of the present applicant/respondent. Amount being paid is subject to the final outcome of the present lis. If in case excess amount is released, then the same shall be recoverable alongwith interest from the applicant.
