This matter is taken up on mentioning as unlisted item in supplementary-2. [2]
Heard Mr. L. Gunindro, learned counsel for the petitioners and Mr. H. Debendra, learned Dy. A.G. assisted by Mr. A. Bheigya, learned counsel for the State respondent. [3]
By the present petition, the petitioners submit that they are the owners of the homestead lands –cum- 1st class shop site measuring an area of (i) .0086 hectare covered by CS Dag No. XVII/156 under Patta No. 646, 377, 25 (old) corresponding to new patta No. 35 situated at Village No. 87 (A) - Khwai Bazar, Imphal West and (ii) .0220 hectare covered by CS Dag No. XVII/157 under Patta No. 646, 377, 25 (old) corresponding to new patta No. 35/1360 situated at Village No. 87 (A) - Khwai Bazar, Imphal West. The petitioners are aggrieved by the impugned eviction
order dated 16.09.2025 issued by Sub-Divisional Officer, Lamphel, Imphal West directing petitoners and others to remove unauthorized structure upon Government land under Dag No. 39 & 260.

It is also stated that the revenue authority has made red- marking on the buildings constructed within their patta land without giving notice to them. [6]
On the other hand, Mr. H. Debendra, learned Dy. A.G., submits that impugned eviction order dated 16.09.2025 issued by the Sub-Divisional Officer, Lamphel, Imphal West is for eviction of encroachment upon Government land under Dag No. 39 & 260 of Village No. 87 (A) Khwai Bazar, Imphal West. The markings made by the revenue authority are preliminary finding and actual eviction and demolition will be conducted after finalization of the actual encroachment by the respective owners. It is also clarified that by the impugned eviction order, the State Government has not contemplated any eviction on the patta land. [7]
Mr. L. Gunindro, learned counsel for the petitioners, also submits that the petitioners have submitted an objection dated 04.09.2025 to the authorities and the same is pending. [8]
On consideration of the materials on record and
submissions made at the bar, this Court is of the opinion that writ petition may be disposed of at this stage by directing the State respondent to consider the objection submitted by the petitioners and to give them ample opportunity of being heard while deciding the amount of alleged encroachment made upon the State land. [9]
Any eviction upon the alleged encroachment be done after proper verification and being heard. [10]
With this observation, writ petition is disposed of. [11]
The possession and structures of the petitioners within their patta lands are protected. [12]
This Court does not express any opinion on the merit of the case. [13]
Furnish a copy of this order to the learned counsel for the parties during the course of the day.
