Learned Panel Counsel appearing for the Petitioner submits that the “Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002” (for short ‘SARFAESI Act’) has been enacted by the Parliament for the speedy & easy recovery of debts, and therefore, long pendency militates against the intent of legislation. He also points out that the statute prescribes a period of 30 days within which such applications need to be disposed off. 2. Notice to the respondents is dispensed with since there is no requirement in law of issuing such notice in proceedings under Section 14 of the Act and therefore, there is no requirement of issuance of notice in the writ proceedings that arise from such a pending application. 3. Having heard the learned counsel for the petitioner and having perused the petition papers, this Court is broadly in agreement with the submission made on behalf of the petitioner and therefore consistent with a catena of decisions rendered by this Court, the petition is favoured.
