No.4622/2023 filed by the respondent/husband pending on the file of the IV Additional Principal Judge, Family Court, Bangalore to the file of the Principal Civil Judge and JMFC Court, Challakere. 2. The facts of the case are that the marriage between the parties was solemnized on 29.08.2021 at Challakere as per the Hindu rites and customs. It is the case of the wife that on 12.03.2022 she was thrown out of the matrimonial home at Tumkur. Thereafter on 20.07.2023, the respondent/husband had filed MC.No.4622/2023 seeking for dissolution of marriage before the IV Additional Principal Judge, Family Court at Bangalore. On 09.02.2024, the petitioner/wife filed Crl.Misc.No.155/2024 at Principal Civil Judge and JMFC Court, Challakere. 3.Learned counsel appearing for the petitioner/wife submits that wife is staying along with her old aged parents in Challakere and the distance between both the places is about - 3 - NC: 2025:KHC:15650 CP No. 142 of 2024 200 kilometers and it is difficult for the wife to travel from Challakere to Bengaluru on each date of hearing. 4. This court had directed the learned counsel appearing for the petitioner/wife to take out hand summons on the counsel for the respondent. Accordingly, he has taken out notice and filed a memo to that effect. But no vakalath is filed on behalf of the respondent/husband. 5.Considering the facts that petitioner/wife is residing at Challakere with her old aged parents and the distance between both the places is about 200 kms, already the wife has instituted a Cri.Misc.No.155/2024 on the Principal Civil Judge and JMFC Court, Challakere, this court deems it appropriate to pass the following: ORDER i. M.C.No.4622/2023 pending on the file of the IV Additional Principal Judge, Family Court, Bangalore is withdrawn and transferred to the file of the Principal Civil Judge and JMFC, Challakere. - 4 - NC: 2025:KHC:15650 CP No. 142 of 2024 ii. The petitioner/wife shall co-operate with the trial and shall not seek unnecessary adjournments. iii. Accordingly, the Civil Petition is Allowed. iv.
