Crl.O.P.(MD) No.20930 of 2025 For Petitioner : Mr.G.Karnan For Respondents : Mr.R.M.Anbunithi Additional Public Prosecutor for R1 O R D E R The petitioner seeks to quash the F.I.R. in Crime No.121 of 2023 pending on the file of the first respondent Police, registered under Sections 41(1)(d) and 102 of Cr.P.C.,1973. 2. It is alleged that the petitioner, who was running a jewellery shop, was found in possession of 186 grams of gold jewels in a suspicious manner; that the jewels were seized on 05.03.2023; that the respondents have not yet ascertained as to what is the offence said to have been committed by the petitioner; and that the F.I.R is still pending investigation. 3. The learned Additional Public Prosecutor, on instructions, would submit that the respondents would ascertain, if any offence is committed by the petitioner and would file a final report within a period of four weeks. ____________ https://www.mhc.tn.gov.in/judis

4. Admittedly, the impugned F.I.R has not been registered for any cognizable offence. It is on suspicion, certain jewels were seized from the petitioner on 05.03.2023. Even though, 2 ½ years have elapsed, the respondents are still unable to state as to what is the offence said to have been committed by the petitioner. Hence, the respondents are directed to close the impugned F.I.R, if they are unable to detect the commission of any offence. It is needless to say that if any offence is detected, a final report has to be filed. However, the respondents shall conclude this exercise within a period of four weeks from the date of receipt of a copy of this order.
5. With the above direction, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. 24.11.2025 NCC : Yes / No Index : Yes / No Internet : Yes / No
