The District Revenue Officer, Dindigul District. 2. The Revenue Divisional Officer, Dindigul District. 3. The Tashildar, Natham, Dindigul District. 4. R.Viswanathan ...Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus call for the records in the Impugned Patta Transfer No. 3769 issued by the 3rd respondent confirmed by the 2nd respondent in Na.Ka.8141/2022/B4 dated 30.04.2024 and consequent revision order passed by the 1st respondent in Na.Ka.2052837/2024/B4 dated 18.09.2025 and quash the same and consequently directing the 3rd respondent to conduct afresh enquiry and consider and pass order within time stipulated by this Court. ] 1/5 https://www.mhc.tn.gov.in/judis For Petitioner : M/s.RM.Arun Swaminathan For Respondents : Mr.P.Thambidurai Government Advocate ORDER The petitioner assails patta transfer No.3769, as confirmed by the Revenue Divisional Officer on 30.04.2024 and subsequently by the District Revenue Officer on 18.09.2025. 2. The principal contention of learned counsel for the petitioner is that the name of the petitioner's father, Ramasamy, was recorded in the revenue records relating to the relevant survey numbers. He submits that the patta was transferred, without notice to the petitioner, on 08.03.2021 in the name of the 4th respondent. In spite of raising the ground of contravention of principles of natural justice, learned counsel submits that neither the Revenue Divisional Officer nor the District Revenue Officer interfered with the order of the Tahsildar. 3. Learned Government Advocate accepts notice for the respondents 1 to 3. He submits that the challenge is in relation to concurrent orders of the Revenue Divisional Officer and the District Revenue Officer. 2/5 https://www.mhc.tn.gov.in/judis 4. The admitted position is that the petitioner was heard both by the Revenue Divisional Officer and the District Revenue officer. On perusal of the order dated 18.09.2025 of the District Revenue Officer, it is noticeable that it is recorded therein, in relevant part, as under:- Gy vz;.630/1> Gy vz;.630/2 kw;Wk; 685/16 Mfpa Gyq;fspy;> epycilikg; gjpT Nkk;ghl;Lj; jpl;l "m" gjpNtL kw;Wk; mjw;F Ke;ija tUtha; Mtzq;fspy; kDjhuu; jpU.ghujp ngaNuh my;yJ kDjhuupd; je;ij rpd;ddd; kfd; uhkrhkp vd;gtu; ngaNuh jhf;fy; nra;ag;gltpy;iy. epycilikg; gjpT Nkk;ghl;Lj; jpl;lj;jpw;F Ke;ija ifr;rpl;lhtpy; vz; 380 kw;Wk; 55 Mfpatw;wpy; ,lk;ngw;Ws;s rp.uhkrhkp vd;gtu; rpd;ddd kfd; uhkrhkp jhd; vd;gjw;F Mjhukhf vt;tpj Mtzq;fSk; kDjhuuhy; tprhuizapd;NghJ rku;g;gpf;fg;gltpy;iy. After recording the above findings, the District Revenue Officer referred to the circular dated 17.07.2023 of the Commissioner of Land Administration to the effect that revenue authorities are not competent to decide disputes relating to title and directed the petitioner to seek relief before the jurisdictional civil court. 3/5 https://www.mhc.tn.gov.in/judis 6. In the above facts and circumstances. I am not inclined to interfere with these findings in exercise of discretionary jurisdiction. Therefore, by leaving it open to the petitioner to approach the jurisdictional civil court, this writ petition is disposed of without any order as to costs. Consequently, connected miscellaneous petitions are also closed. 14.11.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR To 1. The District Revenue Officer, Dindigul District. 2.
